Foreclosure Defense and Mortgage Modification:
Our country has seen a historic number of foreclosure actions filed by lenders
forcing families from their homes. Our foreclosure defense division focuses in
representing homeowners and helping them stay in their homes longer. The banks
filing these foreclosures often do not possess the original bank loan or are not
the correct entity that owns the loan. We will force them to prove their case
in court and examine every aspect of the loan to see if these companies violated
federals laws such as RESPA and TILA. You have options but only if you choose
to do nothing, the bank will sell your house.
Our goal is to keep you in your house and stop the foreclosure. This is often
accomplished by Modifying the original mortgage to a monthly amount that you can
afford. We work with lenders to modify or "work out" the loan so that you can
afford the payments. This program can be very successful and should only be
entrusted to an attorney.
Overtime and Wage Issues:
Overtime pay is the law! Under the FLSA (Fair Labor Standards Act), you are
entitled to one and a half times your regular pay rate for every hour worked
over 40 hours in a regular work week. This can include not just hourly
employees but also salaried employees and commissioned employees. You can
potentially recover these "lost" and "unpaid" wages for up to 3 years back from
any employer.
FDCPA/Collection Agency Abuse:
This is an area rampant with abuse by collection agencies. They routinely
violate the strict consumer provisions of the FDCPA in order to collect alleged
debts for which they paid pennies on the dollar to purchase from the original or
subsequent creditors. We have successfully litigated and settled many cases
against the collection agencies and collection law firms. We protect our clients
from being harassed and ridiculed by the collectors. We have seen a rash of
collection activity in the last few years, and we can help you.
State and county lawsuits by collection agencies and law firms:
Closely related to the FDCPA area of law are the state and county lawsuits filed
by collection lawyers. We have often found that they did not comply with the
FDCPA before filing these lawsuits and very often are suing on a debt that is past
the statute of limitations for collection enforcement. They hope that the
consumer will not respond to the summons and lawsuit in order to get a default
judgment on a debt that was never legally enforceable in the first place. If
